Domain Availability Audit

An audit with Worldwide coverage with the Domain extensions categorised by registry requirements (None/Documents required/ Proof of entitlement). This kind of audit is useful for the research phase or new brand launches. Whois details of unavailable names may be included.

Portfolio Audit

  • Pre-existing portfolio of domains specified by client
  • Three-pronged approach:
    1. whois look-up of each name
    2. Exact string European/Worldwide ccTLD and gTLD search - Finds additional domains registered by client
      Advantage: Highlights 3rd third party use of brand
    3. Reverse Whois look-up tools for gTLDs (not 100% accurate) and .uk - finds names registered through other providers by client

Domain Name Recovery Analysis

If a client spots a domain name infringement and is not aware of how to proceed with the recovery of the domain, domain recovery analysis report comprehensively sets out the details associated with the registrant of the infringing domain name utilising the following techniques:

  • Domain Whois.
  • Website content, and outwards and inwards links of interest, associated email address or contact details.
  • Traditional Reverse Whois analysis (ie using database of registrar Whois information for gTLDs and .uk names) on registrant, email address, address, name servers, or IP address.
  • Reverse IP Analysis, which identifies additional domain names hosted on the same servers even if they have different registration or contact details.
  • General internet searching using a variety of advanced search techniques for gathering further details on the registrant, or information associated with the domain name.
  • Queries of WIPO, or relevant DRP case databases for references to the registrant, or the domain name in previous or existing cases.
  • Registrant background - research via Hoovers, Dun and Bradstreet, local Companies registers. Whois history, to identify incidents of frequent contact detail or registrant updates.
  • Investigation into historical usage of the website to check for previous website versions, their content, and updates.

The report also includes analysis of the specific case and expert recommendations on how best to proceed in recovery of the domain name.

DRP and UDRP Case Management

CPA Global offers assistance right through the Uniform Dispute Resolution and recovery process. Where domain recovery analysis shows that: the domain name in question is identical or confusingly similar to a trade mark or service mark in which our client has rights; and the domain name registrant has no rights of legitimate interests in respect of the domain name; and the domain name has been registered and is being used in bad faith, then we can send a cease and desist letter to the infringing registrant, or file a dispute on behalf of our client in the appropriate official dispute resolution service. CPA Global will: prepare and file the claim with UDRP/DRP service provider on behalf of the customer following detailed review of relevant DRP cases i.e. relevant decisions (similar fact situations, any involving the registrant etc); review response from registrant (if any) and prepare and file response to registrant arguments on behalf of the client; Manage all administrative proceedings during course of UDRP/DRP including correspondence with UDRP/DRP service provider if necessary; Receive, review and communicate panel determination to the client; Assist customer with transfer of domain name to customer if claim successful.

Domain Name Acquisition

CPA Global also offers assistance in the acquisition of domain names, by purchase, where our client has no legal rights to the name or where purchase provides faster turn-around than DRP. Anonymous negotiations for purchase of domain name possible
This process is designed to secure domain names when either a prospective registrant has no legal rights to the name (and thereby cannot avail themselves of dispute resolution processes) or where purchase provides a faster turn-around than DRP.
The client will inform CPA Global of the maximum budget for the purchase of the domain name. This may be agreed prior to any negotiations or after initial contact has been made with the registrant of the domain name. We will initiate contact with the registrant and negotiate the optimal price as well as arranging the method of settlement of monies and transfer of the domain, providing the client complete anonymity in the transaction, and thereby lowering the purchase price.
