Dell fights cyber-criminals in court
05 December 2007
| Domains | Internet
In October of this year Dell filed a lawsuit under seal without notice (to avoid the destruction or editing of evidence) against several individuals and 3 domain name companies: BelgiumDomains, CapitolDomains, and DomainDoorman.
The defendants have been accused of cybersquatting, trademark infringement and dilution as well as counterfeiting, deceptive trade practices and unfair competition.
These accusations have been brought against the defendants because they used the Dell trademark or something very similar in a scam covering over 1,100 domain names designed to earn money from ad revenues.
Dell has accused the defendants of a variety of offences: cybersquatting, trademark infringement and dilution, counterfeiting, deceptive trade practices and unfair competition.
What is unique about this case is with Dell accusing the defendants of counterfeiting, if successful in prosecuting them the possible damages awarded would rise from $100,000 to $1 Million per violation.
Neither party have commented any further on the case, but IP Review Online will report with the latest updates as and when they come out.
