IBM requests bans on Asus imports over patent complaint
IBM has asked the US government to ban certain imports from Asustek, a Taiwanese PC manufacturer, stating that the computers they produce infringes on three of their patents.
Ari Fishkind, an IBM spokesman, said "They use the patented technology for computers they make for others as well as their own brand computers". There was no comment made on the names of the other brands or whether they could be included in the complaint. It is however known that brands such as Apple and Dell are customers of Asustek.
"Asustek continued to sell computers using IBM technology after a licensing agreement between the companies expired on December 31, 2004 … It's in the commission's hands. It's not for us to determine," Fishkind said.
IBM claims that the patents can be found in notebooks, servers, routers and other components.
Asustek has denied the allegations, "We have consulted our lawyers in the U.S. and they have concluded that the complaint has no merit," said Beck Lee, a spokesman for Asustek in Taipei.
The complaint was filed with the US International Trade Commission and they have a 45-day period in which to make a decision. CPA will report as soon as more information becomes available.
