Shares in Tivo Inc rocketed almost 30% after the home entertainment manufacturer won a patent infringement case against Dish Network.
The case came about when Dish Network, a major US satellite TV provider, requested the USPTO to re-examine a TiVo regarding Digital Video Recorders (DVR).
The USPTO upheld the patent and last week a 3 panel judge with the US Court of appeals affirmed a previous court ruling that confirmed Dish Network, previously operating under the name Echostar Communications, infringed on the "Time Warp" technology created and owned by TiVo.
Damages of $74 million was awarded to TiVo for the infringement, but a further $20 million was added to cover interest lost since the case began. As a result of TiVo winning the case, stocks rocketed nearly 30%, closing at $8.77 a share.
Dish Network has assured it's customers that the patent case will not affect them as they have already developed software that doesn’t infringe on the TiVo patent. The company also plans to appeal the decision.
